One Previous Owner - A Used Car Dealers Nightmare

That's right, Ohio courts have ruled that informing a consumer that the vehicle they are purchasing has only had one owner acts to create a warranty EVEN IF THE CAR IS SOLD "AS IS".

Can you imagine the number of used vehicles currently being advertised (especially by new/used vehicle dealerships that have access to factory official vehicles, rental fleet vehicles and lease return vehicles) that dealerships are promoting as only having "one prior owner!"

To make matters worse, can you imagine all the salesmen on the lots of dealerships that have access to the history of the vehicle the customer wants to buy. In an effort to impress the customer or close the sale, the salesman innocently blurts "This car has only had one prior owner!"

In each of those situations, if the dealership fails to integrate the statement that the vehicle has only had one prior owner into the purchase order, according to very good case law in Ohio, the dealer is in violation of the Ohio Consumer Sales Practice Act. A violation of the CSPA enables the consumer to rescind the transaction or obtain treble damages.
